EASTER AT THE BEECHWOOD HOTEL AS JNC WIN FIRST ROUND!

Posted on April 6, 2009. Filed under: Housing News |

Justice Not Crisis appeared in the County Court today to face allegations from the owner of the Beechwood Hotel Mr Kang that we had destroyed property were likely to cause a public nuisance and should be evicted immediately. Nice try Mr Kang but that is not what we are about.

The District Judge said there was no case to answer for an interim possession order which would of seen occupants evicted within 24 hrs. The correct rules had not been applied and the case was listed for trial. Lee Moore representing the occupants in Court said “there was a substantial defence and that JNC would defend the action against Mr Kang”

A Barrister acting for Manor Coast Limited owned by Kang of 7 Barlows Road, Edgbaston was unable to offer an argument for a forthwith possession and the Judge ordered the case to go for full trial on 16th April 2009.

Evidence was presented to the court that Mr Kang has allowed his property to be used as a dumping ground and burning of highly toxic waste. He was unable to establish that the occupiers were any threat to his property.

We will now continue to restore the conservation area back to its full potential and clean up the rubbish. A weekend of activities is planned check our diary of activities for more information.
